1. Acceptance of Terms

By accessing or using the West Coast Kitchen website at westcoastkitchen.ca, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our website or services.

2. Products and Orders

• All products are subject to availability. We reserve the right to limit quantities or refuse orders at our discretion.
• Prices are listed in Canadian dollars (CAD) and are subject to change without notice. The price displayed at checkout is the price you pay, plus applicable taxes and shipping.
• We strive to display accurate product descriptions and images. Minor variations in appearance, weight, or colour may occur due to the handcrafted nature of our products.
• Allergen and dietary information is provided in good faith. Because our products are made in a shared kitchen, cross-contact with allergens is possible. If you have a severe allergy, please contact us before ordering.
• Payments are processed by Stripe through a secure, hosted checkout page. By placing an order, you also agree to Stripe's end-user terms. We do not see or store your credit card details.
• An order is not confirmed until you receive a confirmation email from us. We may cancel and refund any order that appears to involve a pricing error, suspected fraud, or inventory unavailability.

3. Shipping Policy

• We ship within Canada only via Canada Post Expedited Parcel.
• British Columbia: Flat rate shipping of $15 per order.
• All other Canadian provinces: Flat rate shipping of $20 per order.
• Estimated delivery is approximately 3 business days from dispatch, though this is not guaranteed by Canada Post.
• We are not responsible for delays, lost parcels, or damage caused by Canada Post, weather, customs holds, or other circumstances beyond our control.
• Title and risk of loss pass to you once the carrier takes possession of the shipment.

4. Returns and Refunds

Because we ship perishable and shelf-stable food, our return policy is limited:

• We do not accept returns of opened food products for health and safety reasons.
• If your order arrives damaged or you received the wrong items, please contact us within 7 days of delivery at info@westcoastkitchen.ca with photos of the issue. We will work with you to resolve the matter.
• Refunds, when approved, are processed by Stripe back to the original payment method within 5–10 business days.

5. Accounts and Authentication

• You may create an account using an email address and password, or by signing in with Google. You are responsible for keeping your password confidential and for any activity that occurs under your account.
• You must provide accurate and complete information when creating your account and keep it up to date.
• You must be at least 13 years old to use the site, and at least the age of majority in your province to place an order or agree to these Terms.
• We reserve the right to suspend or terminate accounts that violate these terms, are used for fraudulent or abusive purposes, or attempt to circumvent our security or rate-limit controls.

6. WCK AI Agent Chat

Our website includes the WCK AI Agent, an AI-powered chat we're actively refining. It is currently paused— instead of live answers you'll see a feedback panel where you can leave a thumbs-up / thumbs-down and an optional comment.

When the agent is re-enabled, the following terms will apply:

• The agent uses third-party AI (OpenAI) to generate responses. AI-generated content may be inaccurate, incomplete, or out of date. Do not rely on it for allergy-critical, medical, dietary, or other safety decisions — confirm with us directly.
• The agent can read public information (catalog, knowledge base) for everyone. If you are signed in, it can also read your own profile and order history, and add or remove customer notes you ask it to save. It cannot place orders, take payment, or take action on third-party systems.
• Usage is rate-limited and subject to a per-user token budget to prevent abuse. We may further limit, suspend, or alter the agent at any time.
• See the Privacy Policy for details on how AI chat data is handled.

7. Acceptable Use

When using the site you agree not to:

• Reverse-engineer, scrape at scale, or interfere with the operation of the site
• Attempt to bypass rate limits, abuse the AI assistant, or inject prompts intended to extract data you are not entitled to
• Submit reviews, sponsorship applications, or feedback that is false, misleading, defamatory, or impersonates another person
• Use the site for any unlawful purpose or in violation of another party's rights

8. User-Submitted Content

Reviews, sponsorship applications, profile notes, and other content you submit remain yours, but you grant us a non-exclusive, royalty-free, worldwide licence to host, display, and reasonably use that content in connection with operating the site and promoting our business. Product reviews are collected and displayed by Judge.me; their own terms also apply to review submissions.

9. Intellectual Property

All content on this website — including text, images, logos, graphics, recipes, and product descriptions — is the property of West Coast Kitchen and is protected by Canadian copyright and trademark law. You may not reproduce, distribute, scrape, or use our content for commercial purposes without our prior written permission.

10. Disclaimers

The website and services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Nutritional, allergen, and AI-generated content is provided for general informational purposes and is not a substitute for professional medical, nutritional, or dietary advice.

11. Limitation of Liability

To the maximum extent permitted by law, West Coast Kitchen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products. Our total aggregate liability for any claim related to a purchase shall not exceed the amount you paid for that order.

12. Governing Law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of the site shall be resolved in the courts located in British Columbia.

13. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the website after changes constitutes acceptance of the updated terms.
